Daniel McGregor, the man involved in a quad bike crash at Waimarama Beach, is now in a stable condition at Middlemore Hospital, with two broken legs and a broken pelvis.

His 6-year-old daughter, Ashlee Shorrock, also remained stable at Starship Hospital, recovering from serious head injuries.

Mr McGregor, along with two friends and partner Stephanie Lucas, were on the quad bike when it veered down a bank on Okaihau Rd, shortly before midnight on January 2.

Ms Lucas earlier said she couldn't remember who was driving but claimed the three men with her had asked her to tell police she was in charge of the vehicle because she had not been drinking.

All of the adults could face charges if they don't reveal the driver, police have said.
